Funding a Divorce

Deciding to separate from your partner is a daunting step. You’re embarking on an independent future after spending years or even decades as part of a partnership.

You’ll surely have many questions and worries about the divorce process and how much it costs. Luckily, doing the job right doesn’t have to cost the earth.

At Hains & Lewis, we can provide a range of flexible funding options to help you pay for your divorce or civil partnership dissolution case, including:

  • Private funding – fixed fees or agreed ‘pay as you go’ hourly rates depending on your personal circumstances.
  • Family litigation funding – finance to help you pay for the costs of divorce or separation proceedings.
  • Family Legal Aid – available in some cases involving domestic violence, child abduction or other serious issues if you cannot afford to pay your legal fees.

Whichever method of funding suits you, we will be frank and honest about our legal costs from start to finish.

We will provide a detailed quote which breaks down our costs and the work we’ll do for you.

We will never go outside our quoted costs without speaking to you first about the extra work that needs doing so we can get your agreement.

Private funding

Fixed fee divorce

We can offer many of our divorce, civil partnership and separation services on a fixed fee basis. This means we’ll provide a fixed cost for each piece of work, such as our cost for filing a divorce petition, and that is how much you will pay once that work is complete.

This gives you certainty over how much your separation will cost so you can budget accordingly.

Pay as you go divorce

For issues outside our fixed fee services, such as negotiating financial settlements, sorting out arrangements for children and resolving disputes, we can offer a flexible pay as you go service.

Our divorce fees will be based on our hourly rates and agreed with you in advance. Our pay as you go service allows you to make payments towards your fees in manageable chunks when convenient for you.

Depending on your financial circumstances we offer a concessional hourly rate of only £100 +VAT.

This means you always stay in control of your legal spend, no matter how complex the case gets, and you don’t have to worry about getting just one bill at the end.

Divorce litigation funding

We can help you access family finance, a kind of loan that can cover your solicitor fees. We work with Rhea Family Finance to make sure that everyone has the chance to access legal advice and support when they need it. 

The loan covers fees, disbursements and VAT. The loan, plus any interest and fees, is repaid only when you receive your share of any divorce financial settlement.

Here’s how it works:

  • Talk to your solicitor who can provide further advice about divorce funding and whether it is right for you.
  • Your solicitor will start a pre-screen enquiry with Rhea Family Finance.
  • If approved, Rhea Family Finance will set your credit limit and provide a quote for interest and fees.
  • If you are happy to move forward, you will be asked to sign the loan documents and a Deed of Assignment which entitles the finance provider to recover the loan, interest and fees from your share of the divorce financial settlement.
  • The loan, interest and fees will be deducted from your financial settlement by your solicitor, usually at the end of your case or when your solicitor finishes working for you. You do not have to pay anything until the settlement is received.
  • If you come to an agreement with your ex-partner and no longer need the loan, you can cancel up until you sign the agreement and up to 14 days afterwards.
  • You should always seek independent legal advice about the credit agreement before signing anything. As your family solicitors, we cannot provide this advice.

We don’t receive any kickback from the finance provider, our main priority is to help you access the finance you need to secure a fair outcome in your divorce.

Family Legal Aid

Family Legal Aid is unfortunately only available in very narrow circumstances. You can usually only get Legal Aid in divorce cases if you or your family are at risk of abuse or serious harm, such as domestic violence or child abduction.

You may be able to get Legal Aid to pay for mediation if you cannot afford to pay yourself.

We can provide advice about whether you may be eligible for Legal Aid.
